1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (whether an individual user or a corporate entity, “you” or “Licensee”) and Mashyo (“Mashyo,” “we,” “us,” or “our”), governing your access to and use of SHARA – Screen Annotation & Cursor Highlighter (including the Perpetual Free tier, the 14-day Reverse Trial, and “SHARA Pro,” collectively the “Application” or “Software”) and our website at sharacursor.com (the “Site”).

By downloading, installing, running, or purchasing a license for SHARA, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization or enterprise, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree, do not install, access, or use the Application or Site.

These Terms apply to both commercial entities and individual consumers. Nothing in these Terms limits or waives any non-waivable statutory consumer protection rights you may enjoy under applicable local law.

2. Developer Identity

Mashyo is an independent software studio operated by a solo developer, registered in Türkiye, dedicated to building private, local-first Windows productivity and presentation utilities. For inquiries, licensing questions, or support, contact us directly at info@sharacursor.com.

3. Distribution & Merchant of Record

SHARA utilizes two distinct platforms for software delivery and licensing:

  • Microsoft Store (Free Distribution Only): The Microsoft Store serves strictly as a packaging, installation, sandboxing, and automatic update delivery channel for the free base version of SHARA. SHARA is not sold through the Microsoft Store, and Microsoft does not collect payments, process financial transactions, or issue paid licenses on our behalf. Your download and installation via the Microsoft Store remain subject to Microsoft’s standard Store Terms of Use.
  • Direct Purchase of SHARA Pro via Paddle (Merchant of Record): Our order process for paid SHARA Pro licenses is conducted exclusively by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle (Paddle.com Market Ltd, Judd House, 18-20 London Street, London, EC3R 7JP, UK, or its applicable regional affiliates) handles payment processing, customer billing inquiries, tax calculation and remittance (including VAT/GST/sales tax), invoicing, fraud prevention, and returns. All direct purchases are subject to Paddle’s Buyer Terms and Paddle’s Privacy Policy. In the event of a direct conflict between these Terms and Paddle’s Buyer Terms regarding the transactional payment process, Paddle’s terms shall govern that transaction.

4. License Grant, Tiers & Commercial Use

SHARA is licensed, not sold. Subject to your continuous compliance with these Terms, Mashyo grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and execute SHARA on compatible 64-bit Windows 10 or Windows 11 devices that you own or control.

  • SHARA Free Tier (Perpetual): We grant you a royalty-free, perpetual license to use the core everyday presentation features of SHARA—including the basic cursor halo with its click flash, the docked toolbar, the cursor-centered SHARA Wheel, Laser pointer, standard Pen, Eraser, Arrow, text labels, screenshots, straight-line assist, undo/clear functions, stroke thickness controls, and one saved color per tool. The Free tier may be used for both personal and commercial purposes at no charge.
  • SHARA Pro Lifetime License: A paid SHARA Pro license is a one-time purchase (not a recurring subscription) that permanently unlocks advanced presentation tools on your devices. This includes the Highlighter, vector geometric shapes (Lines, Rectangles, Circles), the Whiteboard (white, black or grid), customizable color sets and fast-switching hotkeys (Alt+1–4), the comprehensive Focus and Zoom suite (Picture-in-Picture Magnifier, Cinematic Spotlight, Live Zoom, and vertical Broadcast output), extended halo/click styling (including separate left and right click colors), and real-time Keystroke and Mouse visualization.
  • Device & Seat Allowances: A standard individual SHARA Pro license authorizes one named user to activate and use SHARA Pro on up to two (2) devices (such as a primary desktop and a secondary laptop) used solely by that same individual. Organizations must acquire one license per named individual or dedicated workstation. Concurrent sharing of a single license key across multiple employees or team members is prohibited.
  • Commercial & Enterprise Use: Commercial, professional, educational, and broadcast use of SHARA (both Free and Pro) is explicitly authorized. You may freely use SHARA during corporate webinars, client demonstrations, recorded video tutorials, Twitch/YouTube live streams, and virtual meetings.
  • License Restrictions: You agree that you shall not: (a) reverse engineer, decompile, or disassemble the Application; (b) rent, lease, lend, sell, sublicense, redistribute, or commercially host license keys; (c) tamper with, circumvent, or defeat our Cloudflare entitlement verification backend or local entitlement files; or (d) use the Application’s assets or code to train artificial intelligence models or develop directly competing presentation utilities.

5. The Reverse Trial Model

SHARA operates on a transparent, user-friendly Reverse Trial model:

  • 14 Days Full Pro Access: Every new installation of SHARA automatically receives full, unrestricted access to all SHARA Pro features for fourteen (14) calendar days. No account creation, payment details, or credit cards are required to begin this trial.
  • No Forced Lockout or Surprise Billing: At the conclusion of the 14-day period, the Application does not lock you out, expire, or bill you automatically. Instead, SHARA gracefully reverts to the Perpetual Free Tier. Your settings are kept, and you retain permanent, uninterrupted access to the core cursor halo, click flash, docked toolbar, SHARA Wheel, Laser, Pen, Eraser, Arrow, text labels, and screenshots.
  • Optional Pro Unlock: To continue using advanced features (such as Highlighter, shapes, Whiteboard, full zoom suite, and keystroke visualizer) after the 14-day trial period, you may choose to unlock SHARA Pro at any time with a single, one-time payment.

6. Sensitive Data, Keystroke Display & Password Masking Heuristics

SHARA Pro includes a floating on-screen keystroke visualizer designed to display shortcuts, typed text, command keys, and mouse clicks in real time for educational and demo purposes.

Automated Password Detection is Best-Effort Only: SHARA incorporates heuristic checks that attempt to detect focused password fields via Windows accessibility interfaces and automatically suppress keystroke display. However, you acknowledge and agree that automated password detection is technically incapable of guaranteeing 100% detection across all software environments. Many third-party applications, custom web forms, Electron interfaces, terminal emulators, virtual machines, remote desktop sessions (e.g., RDP, VNC, Citrix), games, and non-standard UI frameworks do not expose standard password attributes to the Windows operating system.

User Sole Responsibility: Automated masking is provided strictly as an assistive convenience and never as an absolute security barrier. You remain solely responsible for your own operational security. You agree to manually pause, hide, or disable the keystroke visualizer when entering passwords, PINs, multi-factor authentication (MFA) codes, financial data, cryptographic keys, or proprietary secrets during live streams, screen recordings, or virtual presentations.

Mashyo accepts no responsibility or liability for any inadvertent on-screen visual disclosure, recording, broadcasting, or breach of confidential, privileged, or personal credentials resulting from your use of the Application.

7. System Permissions & Local-First Architecture

SHARA is engineered with Intentional Apps Isolation, ensuring enterprise-grade privacy and zero cloud dependencies for core presentation tools:

  • Full Trust Capabilities: To draw overlays above elevated windows, support smooth global hotkeys, and render picture-in-picture magnifiers without latency, SHARA requires Windows runFullTrust and uiAccess capabilities within the Windows App Model. Mashyo warrants that these privileges are utilized strictly to render real-time UI elements and are never used to access unauthorized user files or monitor unrelated background activity.
  • Zero Cloud Telemetry: Screen annotations, drawn ink, cursor positions, magnifications, and visualized keystrokes exist exclusively in volatile system RAM on your machine. They are never captured, recorded, streamed, or uploaded to external servers. SHARA contains zero third-party advertising SDKs or tracking frameworks.
  • Minimal Entitlement Verification: Network connectivity is initiated solely when opening the embedded Paddle checkout window (via Microsoft WebView2) or performing secure HTTPS lookups to our Cloudflare Workers/KV backend to verify or restore a purchased SHARA Pro license using your transaction ID or purchase email address.

8. Pricing, One-Time Payment & Refunds

Pricing & Taxes: SHARA Pro is sold as a one-time lifetime license. Prices are displayed in your local currency as detected by Paddle and may include or exclude applicable sales tax, VAT, or GST depending on your country. Paddle, as Merchant of Record, calculates, collects, and remits all indirect taxes. We reserve the right to modify pricing for future license purchases at any time without retroactively affecting previously purchased licenses.

Immediate Digital Performance: Upon purchase through Paddle, your license is delivered and unlocked digitally and immediately within the Application. Where applicable under European Union, UK, or other statutory consumer laws, you expressly acknowledge and agree that digital delivery begins immediately upon purchase confirmation, and you waive any statutory cooling-off withdrawal period once digital access to SHARA Pro has commenced.

Refund Policy: We stand behind our software. SHARA Pro carries a 14-day money-back guarantee: you may request a full refund within fourteen (14) days of purchase, for any reason, in accordance with our Refund Policy. Refund requests may be submitted to info@sharacursor.com or processed directly through Paddle’s self-serve buyer support at paddle.net. Upon issuance of a refund, your SHARA Pro entitlement will be revoked, and the Application will revert to the Perpetual Free tier.

9. Software Updates & OS Compatibility

Mashyo may release maintenance updates, bug fixes, or enhancements via the Microsoft Store or our Site. While we make good-faith efforts to ensure smooth performance across 64-bit Windows 10 and Windows 11 systems, we do not guarantee uninterrupted compatibility with every future Windows update, third-party software update, display driver, or multi-GPU workstation configuration.

10. Intellectual Property Rights

All title, copyright, trademarks, and intellectual property rights in and to the Application, the Site, underlying source code, design assets, algorithms, and branding (including “SHARA,” “Creator Kit,” and “Mashyo”) are owned exclusively by Mashyo or its licensors. You acquire no ownership rights under these Terms, and all rights not expressly granted are reserved by Mashyo.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE APPLICATION, THE SITE, AND SHARA PRO ARE PROVIDED STRICTLY “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. MASHYO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY OF PASSWORD MASKING, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, MASHYO DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR INDIVIDUAL REQUIREMENTS, THAT ITS OPERATION WILL BE COMPLETELY UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE RESOLVED.

12. Limitation of Liability & High-Risk Activities

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MASHYO, ITS SOLE DEVELOPER, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER — INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, CORRUPTION OF FILES, UNAUTHORIZED ON-SCREEN DISCLOSURE OF INFORMATION OR PASSWORDS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE SHARA, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF MASHYO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES SHALL MASHYO’S TOTAL CUMULATIVE LIABILITY ARISING UNDER OR IN CONNECTION WITH THESE TERMS OR THE APPLICATION EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR YOUR SHARA PRO LICENSE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS GREATER.

High-Risk Activities Disclaimer: SHARA is a desktop presentation utility. It is not fault-tolerant and is not designed, tested, or certified for use in hazardous, life-critical, medical, emergency response, aviation, or high-risk operational environments where software failure could lead to physical injury, death, or severe environmental destruction.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mashyo and its developer from and against any claims, liabilities, damages, losses, costs, and legal expenses arising out of or related to: (a) your violation of these Terms; (b) your unauthorized distribution or modification of the Software; or (c) any content, screen imagery, or confidential data broadcast, streamed, or displayed by you while using the Software.

14. Termination

These Terms remain in effect until terminated. Your license rights will terminate automatically without notice if you fail to comply with any material condition herein (such as tampering with licensing checks, distributing unauthorized keys, or attempting to resell the Software). Upon termination, you must cease all use of the Application and delete all local copies from your devices.

15. Governing Law & Dispute Resolution

These Terms, and any dispute arising out of or related to SHARA, shall be governed by and construed in accordance with the substantive laws of Türkiye, without giving effect to any conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Before pursuing formal legal remedies, you and Mashyo agree to attempt in good faith to resolve any dispute informally by writing to info@sharacursor.com. If a dispute cannot be resolved informally within thirty (30) days, the courts located in Istanbul, Türkiye shall have exclusive jurisdiction, except where mandatory consumer protection statutes in your home country grant non-waivable local jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO COMMENCE OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE PROCEEDING, OR REPRESENTATIVE LAWSUIT AGAINST MASHYO.

16. Severability & Entire Agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and Refund Policy, constitute the complete and exclusive agreement between you and Mashyo concerning SHARA and supersede all prior discussions, representations, or understandings.
